1. Overview

These Terms & Conditions ("Terms") govern your access to and use of PadScribe and related services (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

This document is provided for informational purposes only and is not legal advice. You should review and adapt it with your own legal counsel.

2. Eligibility & account

• You must be at least 18 years old to use the Service.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You agree to provide accurate information and to notify us of any unauthorized use of your account.

3. Credits, billing & refunds

• PadScribe uses a credit-based system. Each generation of listing content consumes credits as described in the app.
• Credits are purchased through our payment provider (Stripe) and are non-transferable.
• Unless otherwise required by law or explicitly stated, credits and fees are non-refundable once used.

4. Use of the Service

You agree that you will not:

• Use PadScribe to create content that violates applicable law, MLS rules, platform policies (e.g., Airbnb, Vrbo), or Fair Housing requirements.
• Attempt to reverse engineer, scrape, or misuse the Service or its underlying models.
• Upload content you do not have the right to use (e.g., copyrighted photos without permission).
• Use the Service in a way that disrupts or harms other users or infrastructure.

5. Content & ownership

• You retain any rights you have in the property photos and other content you upload to PadScribe.
• Subject to your compliance with these Terms, you may use AI-generated listing content for your own marketing and business purposes.
• You grant us a limited license to process your content for the purpose of providing, maintaining, and improving the Service.

6. No legal, financial, or compliance advice

The Service is designed to assist with drafting listing descriptions but does not provide legal, financial, or compliance advice. You are solely responsible for reviewing and editing all content before publishing it to MLS, Airbnb, Vrbo, or any other platform.

You should consult with your own legal counsel or compliance team to ensure that your listings meet all applicable laws, regulations, and platform rules.

7. Service changes

We may update, modify, or discontinue parts of the Service at any time. We will attempt to provide reasonable notice of major changes where practical.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that generated content will be error-free, compliant with every jurisdiction, or accepted by any particular platform or MLS.

9. Limitation of liability

To the fullest extent permitted by law, PadScribe and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or revenues, arising from or related to your use of the Service.

Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the amount you paid to us for the Service in the 3 months preceding the event giving rise to the claim.

10. Termination

You may stop using PadScribe at any time. We may suspend or terminate your access to the Service if you violate these Terms, misuse the Service, or if we are required to do so by law or by a platform partner.

11. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will adjust the "Last updated" date and, where appropriate, notify you within the app or by email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
